IT Governance and Centre for Assessment launch BCM and Information Security workshops for Legal Profession (May 2013)

Professional services company, IT Governance, in association with independent certification body and registered Lexcel provider, Centre for Assessment, have announced the first Business Continuity and Information Security advice workshop, ‘compliance surgery’ and networking event to be focussed on the requirement of the SRA Code of Conduct 2011.

Whilst it should be intuitively obvious to anyone running a firm of solicitors that it is a good idea to have some sort of plan form when things go wrong, new legislation actually uses the term ‘business continuity’ and requires firms to assess the risks of, in this case, operational disruption, upon which its resulting plans and arrangements should be based. This approach is a significant improvement on the requirements of the previous legislation and is also much closer to best practice enshrined within ISO 22301, the international standard for business continuity management systems.

The SRA Code of Conduct 2011 IB(7.3) lists the indicative behaviours of “…identifying and monitoring financial, operational and business continuity risks including complaints, credit risks and exposure, claims under legislation relating to matters such as data protection, IT failures and abuses, and damage to offices”.

Can your practice show that you have complied with the Principles of the Code, particularly in regard to data protection, IT failures and abuses - e.g. cyber-attack/hacking? For example: a risk-based approach to information security involves identifying: the firm's information assets; threats to those assets, and their likelihood and impact; ways to reduce, avoid or transfer risk. A comprehensive risk-based assessment can be a complex task, so you may need expert advice.
